      Callahan v Phillips Judgement is granted unto John Callahan against James Phillips, Administrator of Ann Simpson, deced for ye sum of three thousand one hundred forty three pounds of tobacco being ye ballance due to John Callah an Estate as alsoe his part of ye Cattle which is ordered to be for with paid with costs als Exo.
      Callahan v Phillips John Callahan haveing brought his action of Account against James Phillips it is therefore ordered that Mr. Bryan Stott, Junr. Mr. Stephen Tomlin, Mr. William Rogers, Mr. Thomas Carpenter and Mr. Robert yo ung or any four of them doe meet att some convenient time between this and the next court upon ye Plantation of John Callahan in this County and value what damages ye Plantation hath sustained by the decay of housing, fencing, orchards and c. wi thin the space of nine yeares last past and make report thereof to the next Court under thier hands&c.

      Callahan v Phillips John Callahan haveing brought his action of Account against James Phillips and thereupon haveing obtained an Order of this Court bearing date ye 8th September 1703 for men to view ye damage done to the Plant ation of ye Plt. against the Deft. and being thereof possest and they haveing found damages to seven thousand pounds of tobacco the Defendant by his Attorney alledged their report was not lawfull neither ought they to have made such a retune unles s they had been sworne by a Justice of the Peace and thereupon the Plaintifee prayed that a Jury might be impannelled to goe upon the Plantation of the Plt. between this and the next Court and value the damages being legally sworne and make thei r report to the next court under their hands and the Deft. being in Court and pleading nothing in barr, it is therfore ordered that the Sheriffe of this County or his Deputy doe forthwith impannell a Jury of Freeholders of the Vicinage to meet upo n the land and they being legally sworne to keep together untill they have concluded their Verdict and the same to returne to next Court as a foresaid under their hand and seales.
      WILLCOX Ordered that John Willcox doe forthwith deliver ye cattle in his possession belonging to ye Orphans of Darby Callahan/deced/ unto James Phillips upon penalty of incurring the displeasure of the Court and being presen ted to the secuity of ye Law.
      CLARK ordered that Nicholas Clark be admitted Guardian to Darby Calllahn.

      MARY CALLAHAN, Widow of John Callahan, late of this County, deced. came into court and made Oath that John Callahan departed this life without makeing any Will as far as she knows or believes and on her motion and giving sec urtiy for her just and faithfull administration of Decedent's Estate, Certificate is granted her for obtaining Letters of Administration therof in due forme.
      Ordered Thomas Chinn, Thomas, Stott, John Stott and Fielding Nash or any three of them being first sworn before a Justice of Peace for this county, Meet and appraise the Estate of John Callahan, deced, in money , and make rep ort of their proceedings to the next Court and that Mary Callahan, the Administratrix of the Estate, do then appear and make Oath to the Inventory.
      (interesting tidbit Mary Callahan came into Court and made oath that Mary hughs, late of this County, deced,, departed this life without makeing any will as far as she knows and believes and on her motion and giving security for her just and fait hfull administration of the Decedent's estate, Certificate is granted her for obtaining Lettes of Administration therof in due forme. (same court day for her husband)

      In the suit between David George, Plaintiff and Mary Callahan, Executrix of John Callahan, deced by Petition setting forth that the Plaintiff was bound Apprentice to John Callahan to teach him the Trade of a Sawyer and to re ad and write and that he is now eightee years of age and has neither been taught his Trade no had his learning and praying relief against the Defendant in this premis, the parties were heard , where upon Isaac White of St. Mary's White Cappell Par ish in this county became seurity that the Plaintiff should learnt to read and write during the remainder of his service and that he should be kept to his Trade when he was not employed in tending Corne or at school and it is ordered that the Def endant pay unto the Plaintiff his costs in this behalf expended.
